Terms of Service

These Terms of Service ("Terms") govern your access to and use of Drawing Chank, including the iOS app, widget, backend API, and website (the "Service"). The Service is operated by RatNest / SkiF Production ("Drawing Chank", "we", "us", or "our"). By using the Service, you agree to these Terms.

1. The Service

Drawing Chank is a paired drawing app for two linked users. The Service lets users sign in, create or accept an invite code, share a canvas, sync drawing events, generate widget previews, and receive notifications when the shared canvas changes.

2. Eligibility and Accounts

You must be at least 13 years old to use the Service. You are responsible for maintaining control of your Google account and device. You must provide accurate account information and must not use another person's account without permission.

3. Pairing and Shared Content

Pairing links your account with another user. Once paired, both linked users can view and update the shared canvas. Only share invite codes with people you intend to link with. You are responsible for text, drawings, emoji, images, and other content you create or share through the Service.

4. Acceptable Use

You agree not to:

• Use the Service for illegal, harmful, abusive, harassing, or privacy-invasive activity.
• Upload or share content that infringes intellectual property, privacy, publicity, or other rights.
• Attempt to access another user's account, canvas, device token, or data without authorization.
• Reverse engineer, scrape, overload, disrupt, or bypass security protections of the Service.
• Use the Service to distribute malware, spam, scams, or deceptive content.
• Use the Service in a way that violates applicable law or platform rules.

5. Your Content

You retain ownership of content you create. You grant us a limited license to host, store, process, reproduce, transmit, display, and otherwise use your content only as needed to operate, secure, troubleshoot, and improve the Service, comply with law, and enforce these Terms. You represent that you have the rights needed to create and share your content through the Service.

6. Privacy

Our Privacy Policy explains what information we collect and how we use it. By using the Service, you acknowledge that your information will be processed as described in the Privacy Policy.

7. Notifications

If you enable push notifications, we may send notifications related to canvas activity and service operation. You can disable notifications through your device settings.

8. Beta and Availability

Drawing Chank is an early-stage product. Features may change, break, be limited, or be discontinued. We may suspend or stop the Service, impose limits, or remove content where needed for security, legal compliance, abuse prevention, or product operation.

9. Third-Party Services

The Service relies on third-party providers including Supabase, Fly.io, Google, and Apple. Your use of those third-party services may be subject to their own terms and privacy policies. We are not responsible for third-party services that we do not control.

10. Intellectual Property

The Service, including its software, design, branding, logos, and other materials, is owned by us or our licensors and is protected by applicable intellectual property laws. These Terms do not transfer ownership of the Service to you.

11. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms, create risk for the Service or other users, or if we discontinue the Service. Sections that by their nature should survive termination will survive, including ownership, disclaimers, limits of liability, and dispute terms.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, error-free, or that content will always be preserved.

13. Limitation of Liability

To the maximum extent permitted by law, Drawing Chank and its operators, affiliates, officers, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data loss, goodwill, or service interruption arising from or related to the Service or these Terms.

14. Indemnity

You agree to defend, indemnify, and hold harmless Drawing Chank and its operators from claims, damages, losses, liabilities, and expenses arising from your use of the Service, your content, or your violation of these Terms or applicable law.

15. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will take reasonable steps to notify users, such as updating this page or providing notice in the app. Your continued use of the Service after updated Terms become effective means you accept the updated Terms.
